How to Deal with IRS Collections

By Darrin Mish of Law Offices of Darrin T. Mish, P.A.

How to Deal with IRS Collections

The very first step of the IRS collections process begins when you file your tax return without including the amount due yet. The IRS will then send you a bill for the amount owed. This first bill will simply state the explanation of the amount due and then require you to make a payment in full. If you do not pay attention to this notice, another one will be sent to you referencing the period and amount due as well as any applicable charges. Continuing to disregard what the IRS sends you would lea to the receipt of notices that are more threatening in nature. These notices are sent in order and adhere to a specific format. You can actually look these up from the IRS to learn more details about them and know what each actually implies. The bottom line is, if you get these letters, you clearly have issues with the IRS that need to be dealt with as soon as possible.

You can send a letter to or call the IRS if you feel that there were erroneous entries in your payables. They can accommodate discussions with you to re-check the issues and possibly, make the necessary corrections. For example, if you still receive notices even if you have already settled your dues, you may give them copies of your proofs of payment. Just remember that you should keep the original documents for future reference.

Certain payment options are also available in cases when you cannot afford to pay for the full amount of your taxes. An installment payment plan can be arranged with the IRS. In this agreement, you pay for your taxes over a lengthened period, you incur the applicable interest for the unpaid balance, and still are penalized until you have completely paid the full amount.

You can even convince the IRS to put off their collection endeavors for a particular length of time if you are truly unable to make even partial payments as of the moment. You will be considered as currently not collective. However, such state still entitles you to penalties and further interests that will most likely accumulate. This actually just worsens the problem.

OIC, or Offer in Compromise, is a solution most popular to tax payers. When given, this allows you to pay only a percentage of the total amount due and the rest of the debt is forgiven. Although statistically you are likely to be denied in your application for Offer In Compromise, submitting such request will be worth the risk as this would effectively end your IRS problem, at least until the succeeding year.

There are many instances when all it requires to solve an IRS tax issue is to simply call your local IRS office. Some incidents, however, require that you employ the services of an expert for advice on IRS collections methods. Even though you are indebted, the fact still remains that you need to be treated fairly and justly. Just remember that it is to your advantage to respond to any IRS notice. Doing otherwise results to the enforcement of more threatening and more invasive collections procedures.

I can tell right away you're a true expert, I'd never heard of OIC - it makes them sound almost like reasonable people.
